CFTC Proposes Federal Framework for Leveraged Retail Crypto Trading

The CFTC has opened a rulemaking process aimed at creating federal oversight for leveraged and margined retail cryptocurrency trading. The proposal could give crypto exchanges another regulatory route while strengthening nationwide standards for higher-risk trading products. Significantly, the agency cannot force cryptocurrency trading onto CFTC-regulated platforms without new authority from Congress.

CFTC Maps Out New Exchange Framework

The proposal introduces two regulatory structures called Regulation CTX and Regulation CAM. Together, they would establish requirements for CFTC-registered exchanges that offer eligible crypto products to retail traders.

Additionally, the agency could create a new registration category known as a crypto asset market. This framework would offer an alternative to exchanges operating primarily through state licenses.

However, the rules would not create an exclusive federal marketplace for cryptocurrency trading. Congress would need to expand the CFTC’s authority before the agency could impose such a requirement.

Regulators Push Ahead After Congressional Setback

The initiative follows the Clarity Act’s failure to clear the Senate last month. Consequently, federal regulators have pursued other ways to establish clearer cryptocurrency rules within their existing powers. Furthermore, the SEC recently adopted its Innovation exemption and the CFTC has moved forward on other crypto rulemaking initiatives.

The CFTC also seeks greater protection from deceptive practices. So the new plan is a sign of a new trend in the direction of preventive regulation, not just enforcement in the wake of market failure.
