The CLARITY Act faces a tougher path in September as lawmakers lose valuable voting time. The shortened congressional calendar could limit opportunities to advance the sweeping crypto market structure bill. 

Speaking to Fox Business, SEC Chairman Paul Atkins said he expects the Senate to vote on September 15. However, that date covers a procedural step rather than final passage. Senators must first secure 60 votes to begin formal consideration of the legislation.

Senate Must Clear Procedural Barrier

Senate Majority Leader John Thune filed a cloture motion before the August recess. The motion will reach its deadline at 2:15 p.m. ET on September 15. Consequently, supporters must build enough bipartisan backing before debate can begin.

Additionally, senators could face disputes over stablecoin rewards, ethics requirements and financial crime provisions. Those disagreements previously prevented lawmakers from reaching a deal before recess.

The House approved its CLARITY Act version by 294-134 in July 2025. The Senate Banking Committee later advanced its version 15-9 in May 2026.

Calendar Creates Further Pressure

Moreover, the House will leave Washington after its September vote. Its next scheduled voting day falls on November 9.

Hence, negotiators face significant pressure to reconcile both versions quickly. The bill must pass both chambers before reaching President Donald Trump.
