A criminal case involving an FBI agent accused of stealing nearly $1 million in cryptocurrency is raising questions about whether ChatGPT conversations can be used in criminal investigations.
According to court documents, investigators reviewed the ChatGPT history of FBI agent Patrick Yaroch while investigating claims that he made unauthorized withdrawals from a cryptocurrency wallet of a foreign criminal target.
Interestingly, the Prosecutors didn’t use the ChatGPT conversations to prove the theft itself, but they included them alongside blockchain records, financial data, and witness statements. The case shows that AI chat history can be part of a criminal investigation in certain circumstances.
FBI Agent Accused of Stealing Crypto
Prosecutors say Yaroch took about $1 million in cryptocurrency from a wallet the FBI had access to during an investigation.
According to court filings, he later admitted to colleagues that the theft had been “eating him up inside” and that he wanted to confess. Investigators later found cryptocurrency worth about $1 million in a wallet they say he controlled.
Authorities claim the withdrawals happened in late 2024 and early 2025 using a passphrase obtained during the FBI’s investigation. The FBI says Yaroch has been fired and is under investigation.
Why ChatGPT Was Included
Investigators also examined Yaroch’s internet history. Court documents say he asked ChatGPT how to invest $1 million and described a plan to retire around age 40 and live a quieter life in Italy or Portugal.
Prosecutors do not claim ChatGPT helped commit the alleged crime. Instead, they included the conversation as evidence of his financial plans and his awareness of having a large amount of money.
Essentially, ChatGPT can be used as evidence where circumstances permit. Like emails and deleted social media posts, ChatGPT conversations can be obtained through search warrants or subpoenas, depending on the law and the platform’s data policies.
New Source of Digital Evidence
The case also highlights how crypto investigations now rely on many different types of digital evidence. Investigators combine blockchain records with exchange KYC information, wallet activity, browsing history, cloud data, financial records, messaging apps, and AI chatbot conversations.
As more people use AI tools, those conversations provide investigators with information about a person’s plans, intent, or state of mind.
Meanwhile, the allegations against Yaroch have not yet been proven in court. But the case is a reminder that AI conversations, when legally obtained, can become evidence in a criminal investigation.
