The European Union is investigating whether Binance can continue serving customers in Europe without obtaining a license under the EU’s Markets in Crypto-Assets Regulation (MiCA).

According to the Financial Times, the European Securities and Markets Authority (ESMA), along with regulators in France, Germany, and Greece, is questioning whether Binance can legally rely on an exemption that allows certain foreign financial companies to serve European customers without local authorization. Regulators have asked Binance for more information.

The issue follows Binance’s failure to obtain a MiCA license earlier in 2026. Under EU rules, crypto companies operating under temporary arrangements had to obtain authorization or begin closing their EU operations by June 30. The transition period ended on July 1.

Binance says it complies with regulations in the countries where it operates and is working toward obtaining MiCA authorization. 

What Is the MiCA Exemption Binance Is Using?

The exemption is known as reverse solicitation. It allows a non-EU crypto company to serve an EU customer when that customer approaches the company independently and requests a specific service.

The rule is limited. It does not allow foreign exchanges to actively advertise or target European customers without the required license.

This is why regulators are examining Binance’s activities. They are assessing whether Binance’s large European customer base and continued customer onboarding comply with reverse solicitation requirements.

If regulators determine that Binance has exceeded the exemption, the company faces penalties or restrictions on its European operations.

Are Existing Binance Users’ Funds at Risk?

Regulatory restrictions do not automatically transfer ownership of users’ cryptocurrency. They do, however, restrict the ability to trade, deposit, or withdraw funds.

There is already an example of this. In June 2026, some Binance users in the EU faced restrictions following the exchange’s licensing problems. According to The Wall Street Journal, affected users could sell assets and withdraw funds but could no longer trade normally.

This illustrates the difference between access to funds and access to trading services. The restrictions imposed on users will depend on the regulatory action taken and the Binance services affected.

Could Binance Restrict Deposits, Withdrawals, or Trading?

If regulators reject Binance’s use of the reverse-solicitation exemption, Binance faces several possible measures. These include:

  • Stop accepting new EU customers.
  • Restrict certain trading products.
  • Suspend specific services.
  • Give existing customers a deadline to close positions or withdraw funds.

Should European Users Move Their Crypto?

Users concerned about restrictions have two main alternatives: moving their crypto to a MiCA-authorized exchange or transferring it to a personal wallet. Both options have advantages and risks.

A MiCA-authorized exchange operates under EU crypto regulations. A personal wallet gives users direct control over their crypto and private keys. Users are responsible for protecting their recovery phrase. Losing the recovery phrase, sending crypto to the wrong address, or falling for a scam results in permanent losses.

Importantly, users do not need to make a rushed decision based solely on regulatory headlines. 

Could This Affect Crypto Prices?

Binance is one of the world’s largest crypto exchanges. Restrictions would push some European traders toward other platforms, changing where trading takes place and reducing liquidity for some trading pairs.

This does not automatically mean cryptocurrency prices will crash. Some users will move their crypto to another exchange or a personal wallet instead of selling it.

What Should Users Watch Next?

The key issue is whether ESMA and national regulators move from investigating Binance’s exemption to formal enforcement action. Users should distinguish between three separate developments:

  • Regulatory scrutiny: Regulators are questioning Binance’s use of the exemption.
  • Service restrictions: Binance limits specific services.
  • Withdrawal restrictions: Users lose the ability to move their funds.

These are separate regulatory and operational developments. European Binance users should follow official announcements and monitor how any new restrictions affect their country and the specific Binance services they use.
