New York Governor Kathy Hochul and Attorney General Letitia James have announced that the state is suing KalshiEX LLC (Kalshi) for running an illegal gambling operation. Kalshi allegedly violated state gaming laws by allowing bets on sports, elections, and events without a Gaming Commission license, serving users aged 18-20, and avoiding taxes.

Prediction Markets vs. Traditional Sports Betting

Prediction markets are peer-to-peer exchanges that feature binary “yes/no” event contracts with the price implying a probability, and the positions being tradeable prior to settlement. On the other hand, sports betting involves wagers against licensed bookmakers offering fixed odds with a built-in margin of roughly 4–10% (about 4.5% on standard bets).

Meanwhile, prediction markets extend beyond sports, covering political elections and economic changes, generating income solely from minimal trading fees. Regulators are divided on legal classification, with operators claiming that federally registered platforms are “in the hands of the CFTC” because they are purely event-based financial derivatives.

Conversely, state authorities, as illustrated by New York’s suit against Kalshi, consider such deals to be unlicensed gambling and impose state gaming taxes, stringent consumer protections, and age restrictions.

Why New York Is Suing Kalshi 

The Kalshi lawsuit, alongside similar enforcement actions in Massachusetts and parallel lawsuits targeting platforms like Coinbase and Gemini, is a pivotal test for the prediction market ecosystem. 

New York is seeking damages of at least $36 billion, including profit forfeiture, restitution and up to three times the gains, while contesting Kalshi’s reliance on CFTC preemption. The case could lead to greater regulatory fragmentation, higher compliance costs, and even the need to comply in different ways across sports, political, and other event contracts.

The state argues that Kalshi violated the state’s gaming laws by serving users aged 18–20, below New York’s 21 minimum age for mobile sports betting, and avoided taxes that fund programs for addiction and public services. Since sports contracts account for about 80–87% of Kalshi’s volume, any restrictions could significantly affect liquidity and growth across the sector.

New York’s lawsuit against Kalshi could spur a broader regulatory crackdown, but the results will be determined by court rulings, CFTC responses, and legislative actions. As a major financial and sports betting hub, New York’s aggressive stance often influences other states and federal policy.

If New York wins in court, it could embolden attorneys general in dozens of other states, particularly those that depend on their own licensed casinos and authorized mobile sportsbooks to bring in tax revenue.

Moreover, the impact will likely extend beyond the United States. International regulators, including the UK Gambling Commission, the European Securities and Markets Authority (ESMA), and the Australian gaming boards, are closely watching the American courts’ navigation of the intersection between DeFi and gambling.
